The petitioner Jagaman Harijan seeks bail in Sessions Trial No. 628 of 2014, arising out of Sadar (Dagarua) P.S. Case No. 163 of 2013, registered for the offences punishable under Section 304 and other Sections of the Indian Penal Code. The daughter of the petitioner made allegation that the petitioner assaulted his wife with fists and slaps and consequently the mother of the informant died on the next day at about 10:00 A.M.

Learned counsel for the petitioner submits that the petitioner is in jail since 24.05.2014.

Considering the facts aforesaid and the fact that the petitioner is only alleged to have assaulted his wife with fists and slaps and his wife died on the next day and for that the petitioner

Patna High Court Cr.Misc. No.1327 of 2015 (2) dt.13-01-2015 is in jail since 24.05.2014, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Purnea in connection with Sessions Trial No. 628 of 2014, arising out of Sadar (Dagarua) P.S. Case No. 163 of 2013.
