JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.

One country made pistol and three live cartridges were recovered beneath the bed of the petitioner but submission on behalf of the petitioner is that petitioner has falsely been implicated in this case and as a matter of fact, petitioner was made accused in Buxar (T) P.S. Case No. 261 of 2018 and when police did not find any evidence against the petitioner in the aforesaid Buxar (T) P.S. Case No. 261 of 2018, the police implicated the petitioner in this false case.
