The petitioner seeks bail in Bihpur P.S. Case No. 136/2016, instituted for offences under Section(s) 406 and 420 of the Indian Penal Code.
The informant has alleged in the written report that she had given Rs. 4 lacs to the petitioner for getting her son appointed in Army but her son did not get any job. It is further alleged that informant went to the house of petitioner for enquiring about job of her son then he asked for some time. The informant again went to the house of petitioner for demand of aforesaid amount then accused persons assaulted her with fists and slap. They refused to return the said amount. Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.113 of 2019(2) dt.21-01-2019 2/2 there is no any chit of paper in support of aforesaid money having been paid by the informant to the petitioner. There is general and omnibus allegation against this petitioner. Petitioner is in custody since 14.09.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in connection with Bihpur P.S. Case No. 136/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
