The petitioner seeks regular bail in connection with Excise Case No. 382 of 2019 for the offence registered under Section 30(a) of the Bihar Prohibition & Excise Act (Amendment), 2018.
The allegation is regarding recovery of 250.920 litres of illicit wine from a Maruti car and the petitioner was found sitting inside the car whereupon he was arrested by the Police. The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 10.11.2019.

No.3106 of 2020(2) dt.20-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Gopalganj in connection with Excise Case No. 382 of 2019.
