JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 302, 307 and 120B/34 of the IPC as well as section 27 of the Arms Act.

The petitioner is not named in the first information report and from the impugned order it is very difficult to gather what has come against the petitioner in the present case. However, learned counsel appearing for the petitioner submits that the name of petitioner came in this case in the confessional statement of co- accused Uttam Ram @ Sadhu Ram who has already been granted privilege of bail by this court vide order dated 6.12.2018 passed in Cr. Misc. no. 72582/2018.

Patna High Court Cr.Misc. No.242 of 2019(2) dt.17-01-2019 2/2 Perusal of fardbeyan of the informant goes to show that he claims to be eye witness of the alleged occurrence and specifically stated that it were Rameshwar Singh and Kanchan Singh who shot fire at the deceased as well as on him. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Buxar (T) P.S.
