JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 11-09-2017 The present petition has been filed for transfer of Divorce Case No. 273 of 2015 from the Court of learned Principal Judge, Family Court, Vaishali at Hajipur to the Court of learned Principal Judge, Family Court, Muzaffarpur.

2. Learned counsel for the petitioner submits that Complaint Case No. 440 of 2017 has been filed by her under Section 498A of the Indian Penal Code and Sections 3 and 4 of the D.P. Act is pending before the learned Chief Judicial Magistrate, Muzaffarpur. Maintenance Case under Section 125 of the Code of Criminal Procedure in Case No. 64 of 2017 has also been filed by her before the learned Principal Judge, Family Court, Muzaffarpur. It is submitted that the petitioner is a lady and would face difficulty in attending the Divorce Case at Vaishali and hence the same may be transferred to Muzaffarpur where the other two cases filed by her are pending.

3. Learned counsel for the opposite party appears and states that he has no objection in transferring the Divorce Case No. 273 of 2015 to

Patna High Court MJC No.1044 of 2017 dt.11-09-2017 Muzaffarpur, as sought by the petitioner.

4. In the above view of the matter, this Court directs transfer of Divorce Case No. 273 of 2015 from the Court of learned Principal Judge, Family Court, Vaishali at Hajipur to the Court of learned Principal Judge, Family Court, Muzaffarpur.

5. The petition stands allowed.
