In this case, the petitioners are seeking anticipatory bail in connection with Mohania P.S. Case No.438 of 2019, registered for the offence under Section 30(A) of the Bihar Excise (Amendment) Act, 2018.

Allegation has been made that 117 plastic bottles of country made liquor each containing 180 ml., 9 bottles of Whiskey each containing 375 ml. and 18 bottles of Whisky each containing 180 ml. were recovered from the house of the petitioners. The wife of petitioner no.1 was arrest and now, she

Patna High Court CR. MISC. No.3017 of 2020(2) dt.28-02-2020 2/2 has been enlarged on regular bail.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail of the petitioners is rejected. However, if the petitioners surrenders before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
