JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 12.8.2014 in a case registered for the offences punishable under Sections 399,402,353,307 and 120B of the Indian Penal Code and section 25(1-B)a, 26, 27 and 35 of the Arms Act.
A secret informant was received by the police that accused persons were preparing to commit dacoity. Initially one Ganga Paswan and his associate were apprehended. Subsequently other accused were apprehended and regular rifle and cartridges were recovered.
It is submitted by the learned counsel for the petitioner that recovery has not been made from the petitioner and only on suspicion the petitioner has been arrested. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.775 of 2015 (2) dt.09-01-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Ist Class, Patnacity in connection with Fatuha P.S. Case No. 263 of 2014.
