Mrs. Asha Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard Mr. Virendra Kumar, learned counsel for the petitioners and Mrs. Asha Kumari, learned APP for the State through virtual proceedings.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek bail in connection with Runnisaidpur P.S. Case No. 514 of 2021 registered under Sections 30(a), 36, 38(1)(2) and 41(1) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 29.09.2021, charge-sheet has been submitted and are persons with clean antecedent and

Patna High Court CR. MISC. No.3331 of 2022(2) dt.04-03-2022 2/2 allegation is of recovery of 129.600 litres of liquor from a vehicle.

Learned counsel for the petitioners submits that the petitioners are driver and owner of the vehicle and were not knowing who in their absence had kept the liquor in the vehicle and got them falsely implicated.

Learned APP opposes the bail application.

Considering the fact that the petitioners are in custody, charge-sheet has been submitted and are persons with clean antecedent, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.2000/- (Rupees two thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IIcum- Special Judge, Excise Act, Sitamarhi in connection with Runnisaidpur P.S. Case No. 514 of 2021.
