2. The petitioner seeks bail in connection with Barachatti P.S. Case No. 698 of 2022 instituted for the offences under Sections 341, 323, 326, 307, 354(D), 325/34 of the Indian Penal Code.

3. As per prosecution case, the accusation against the accused persons including the petitioner is of brutally assaulting the Informant and her family members. The specific allegation against the petitioner is of assaulting the Informant's uncle Shankar Yadav with an intention to kill him by means of Gadasa.

4. Learned counsel for the petitioner submits that the

No.4457 of 2025(3) dt.24-04-2025 2/3 petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case due to ulterior motive. There is a case and counter case between the parties. The present case is the counterblast to Mohanpur P.S. Case No. 730 of 2022 which was lodged by the co-accused Rakesh Yadav against the Informant and others. There is no direct or specific allegation of any overt act against the petitioner rather the same is general and omnibus in nature. The specific allegation of assault is against the co-accused Rakesh Yadav. Learned counsel for the petitioner further submits that the injury sustained by the injured Shankar Yadav is simple in nature. The petitioner has no criminal antecedent and is languishing in judicial custody since 20.11.2024 without any rhymes or reason.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner and the petitioner having no criminal antecedent, let the petitioner, abovenamed, be released on bail on furnishing bail
