The petitioner seeks bail in Jandaha Police Station (for brevity, PS) Case No 210 of 2019 dated 25.08.2019 instituted for the offence punishable under Section (s) 395 of Indian Penal Code.

The prosecution case is that the informant was told by one of the staff, namely, Raja Kumar regarding a robbery in the office of the courier delivery agent whereby Rs 3.35 lacs collected as COD was looted from the office.

Learned counsel for the petitioner submits that the investigation has revealed that in fact Raja Kumar, staff of the Company had hatched the entire conspiracy leading to the

Patna High Court CR. MISC. No.1361 of 2020(4) dt.20-03-2020 2/3 robbery. Substantial amount (Rs 2,51,000/-), allegedly robbed, in fact has been recovered from Raja Kumar himself. The petitioner, along with others, have been falsely implicated in this case on extraneous considerations. Co-accused Ranjeet Kumar, Kishan Kumar, Kanhaiya Kumar, Prashant Kumar have been granted bail by different coordinate Benches of this Court in Cr Misc No 89 of 2020, Cr Misc No 2461 of 2020, 3815 of 2020 and Cr Misc No 3440 of 2020 respectively.

Learned APP for the State has opposed the prayer for bail. Considering the aforesaid, let the petitioner, above named, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha PS Case No 210 of 2019 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail

Patna High Court CR. MISC. No.1361 of 2020(4) dt.20-03-2020 3/3 bond will be liable to be cancelled.
