The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegations in the FIR, the house of Sudama Paswan and Sonu Paswan were raided and a total of 2592 litres of liquor was recovered.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case only for the reason that he happens to be the father of co-accused Sonu Pawan. Both Sudama Paswan and Sonu Paswan have been enlarged on bail vide order dated 29.2.2020 (Annexure-2). The

Patna High Court CR. MISC. No.12538 of 2021(2) dt.03-08-2021 2/2 petitioner is in custody since 25.9.2020 and has no criminal antecedent.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration grant of bail to the other two coaccused together with the petitioner having remained in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Murar P.S. Case no. 98 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-Cum-Special Judge, Excise, Buxar.
