2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 302, 307, 120(B), 504, 506 of the Indian Penal Code.

3. The prosecution case in brief, is that on 29.6.2023 the petitioner along with co-accused persons came at the door of the informant and started firing due to which husband as well as son of the informant sustained injury. They were brought to hospital where husband of the informant died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. From perusal of FIR, it appears the specific over-act is against co-accused Akhilesh

Patna High Court CR. MISC. No.7471 of 2024(2) dt.17-02-2024 2/2 Ram who fired upon the husband of the informant due to which he died. The petitioner is only member of mob. There is general and omnibus allegation against this petitioner. Similarly situated co-accused Ramashish Ram has already been granted bail by a co-ordinate Bench of this Court vide order dt. 1.11.2023 passed in Cr. Misc. No. 69563 of 2023. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 2.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rajpur P.S. Case No. 262 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-IV, Buxar.
