JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2017 It appears that the bail application of the petitioner was dismissed vide order dated 03.02.2016. But, inadvertently subsequently, vide order dated 09.11.2016, a report was called for from the Superintendent of Police, Gopalganj, under what circumstances, the witnesses are not being produced in Sessions Trial No. 237 of 2006, arising out of Gopalganj P.S. Case No.142/2000 and also the time frame in which the witnesses are likely to be produced. But since no-one was appearing for the petitioner, this Court vide order dated 01.03.2017 the matter was placed for admission.
Perused the report of the Superintendent of Police, Gopalganj, received through letter no.402/P.C, dated 22.02.2017, which reflects that three witnesses out of nine charge-sheeted witnesses have been examined and one witness namely Ramanand
Patna High Court Cr.Misc. No.5489 of 2016 (5) dt.08-03-2017 2/2 Prasad is dead and, hence, only five witnesses are left to be examined. The report further stipulates that all the witnesses are likely to be produced within three months.
In that view of the matter, this application is disposed of with a direction to the learned Court below to conclude the trial as expeditiously as possible in connection with Gopalganj P.S. Case No.142/2000, pending in the Court of learned 1st Additional District and sessions Judge, Gopalganj.
It is expected from the Superintendent of Police, Gopalganj, to produce all the left over witnesses expeditiously. (Dinesh Kumar Singh, J) Ashwini/- U T
