The petitioner in this case is seeking anticipatory bail in connection with Jehanabad Mahila P.S. Case No. 18 of 2019 registered for the offences punishable under Sections 354(B), 354(D), 506, 509, 504 and 34 of the Indian Penal Code, Section 67 of I.T. Act and Section 8 of POCSO Act.
Learned counsel for the petitioner submits that the petitioner is the mother of co-accused Chhote Lal Bind who allegedly enticed away his sister-in-law and with whom is said to have performed marriage in a temple. It is further submitted that no specific role has been attributed to this petitioner. Learned APP for the State has opposed the prayer of anticipatory bail.
Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.2170 of 2020(2) dt.16-01-2020 2/3 wherein this petitioner is the mother of the co-accused Chhote Lal Bind and the submission is that no role has been assigned to this petitioner in enticing the girl who is the sister-in-law of said Chhote Lal Bind and with whom he is said to have performed marriage in a temple allegedly by enticing her and alluring, in the nature of the relationship of this petitioner being mother and there being no allegation against her of committing any overt act, let the petitioner above named in the event of her arrest or surrender within a period of four weeks from today in connection with Jehanabad Mahila P.S. Case No. 18 of 2019 be released on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge, Jehanabad, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e.
(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police
