The petitioner is apprehending his arrest in Singhia P.S. Case No. 46/2019 registered under Sections 366A and 34 of the Indian Penal Code.

Prosecution allegation, in short, is that the accused persons abducted the grand daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. A petition was filed by the victim when she was produced before the Court below in which she had stated that

Patna High Court CR. MISC. No.11179 of 2021(2) dt.21-12-2021 2/2 she had left her house out of her own will.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R. On recovery, the statement of the victim has been recorded under Section 164 Cr.P.C. in which she has alleged of kidnapping and sexual abuse by the petitioner.

Considering the same, I am not inclined to grant anticipatory bail to the petitioner. Prayer is rejected. (Sudhir Singh, J) Pankaj/- U T
