In this case, the petitioners are seeking regular bail in connection with Nathnagar (Lalmatia) P.S. Case No.172 of 2015, registered for the offences punishable under Section 395 of the Indian Penal Code.
Allegation has been made that the petitioners have committed robbery in the broad day light. The petitioners have been named in the FIR.
Learned counsel for the petitioners submits that co-accused Binay Dom has been granted bail by this Court in Criminal Miscellaneous No.11877 of 2015.
Though the petitioners have not arrested, but they have been identified in committing crime and so much so that from the
Patna High Court Cr.Misc. No.7806 of 2016 (3) dt.18-04-2016 2/2 possession of Pawan Yadav one loaded pistol and looted amount was recorded.
In such view of the matter, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, the petitioners may renew the prayer for bail after completing one year judicial custody.
