JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 At the very outset, learned counsel for the petitioners has submitted that petitioner No.4, Pintu Yadav alias Egarah Hazar, has been arrested during the pendency of this application and as such he seeks permission to withdraw this application with respect to petitioner No.4.
In the said circumstances, this application with respect to petitioner No.4 stands dismissed as withdrawn. Petitioners apprehend their arrest in connection with Athmalgola P.S. Case No. 164 of 2018 registered for the offences punishable under Sections 147, 148, 149, 447, 448,
Patna High Court Cr.Misc. No.1529 of 2019(2) dt.23-01-2019 2/3 323, 325, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
FIR has been lodged on the basis of information given by Chaukidar that accused persons, including the petitioners were making firing and two persons have received injuries in that.
Submission of learned counsel for the petitioners is that husband of Rinku Devi, who was injured, has lodged the case but he has not named these petitioners as assailant, rather he has named other accused persons, which will appear from Annexure-2 and petitioners have no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Barh, District Patna, in connection with Athmalgola P.S. Case No. 164 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the
