====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sessions Trial No. 715 of 2018 arising out of Gayghat (Benibad O.P.) P.S. Case No. 249 of 2017, instituted for the offence under Section(s) 395 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. There is no recovery from possession of the petitioner. The name of petitioner has come in the confessional statement of co-accused Golu @ Ujjawal Kumar who has been granted bail by coordinate Bench of this Court vide order dated 19.12.2018 passed in Cr. Misc. 69867 of 2018.

Patna High Court Cr.Misc. No.121 of 2019(2) dt.18-01-2019 2/2 Petitioner is in custody since 25.4.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial No. 715 of 2018 arising out of Gayghat (Benibad O.P.)
