JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 14-01-2015 Both these cases for bail arise out of a common FIR and, hence, they have been heard together and are being disposed of by a common order.

The petitioners seek bail in connection with Sessions Trial No.789 of 2013 and Sessions Trial No.195 of 2014 respectively arising out of Rajoun P.S. Case No. 20 of 2013

Patna High Court Cr.Misc. No.881 of 2015 (2) dt.14-01-2015 2/2 registered for the offences punishable under sections 147, 148, 149, 302 and 120B read with 34 of the Indian Penal Code as well as section 27 of the Arms Act.

Their prayer for bail was earlier rejected by this Court vide a common order dated 23rd March, 2014 passed in Cr. Misc. No.48668 of 2013 and Cr. Misc. No.49895 of 2013. For the reasons assigned in the aforesaid order dated 23rd March, 2014, I am not inclined to grant bail to the petitioners even though they have remained in custody for over eighteen months. Accordingly, the prayer for bail is rejected. Since the petitioners are in custody, the court below i.e., Additional Sessions Judge-III, Banka is directed to expedite the trial and conclude the same as early as possible.
