The petitioner seeks bail in S.T. No.676 of 2015, T.R. No.782 of 2015, arising out of Mojahidpur P.S. Case No.151 of 2015 instituted for the offences under Sections 307, 332, 353, 506, 414/34 of the Indian Penal Code and Sections 25(1B)a, 26, 27, 29, 35 of the Arms Act and Sections 3, 4 and 5 of the Explosive Substance Act.

As per prosecution case petitioner has thrown Bomb and used the fire arms with an intention to kill the family members of the informant. On his information the police came to the place of occurrence and chased the accused persons in which the petitioner was caught with country made pistol as

Patna High Court Cr.Misc. No.6271 of 2016 (2) dt.29-02-2016 well as explosive substance. Petitioner is in jail since 3.8.2015.

Looking to the nature of allegation and period of custody, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the petitioner will be at liberty to renew his prayer for bail after completion of one year in jail custody.
