The petitioner seeks bail in connection with Special Case No.9 of 2012 pertaining to RC 0232012 A 0016 registered under Sections 120-B, 420, 409, 467, 468 and 471 of the Indian Penal Code besides Section 13(2) read with Section 13(1)(c) and (d) of the Prevention and Corruption Act.
The accusation is that the petitioner being the Senior Manager of the Punjab National Bank, posted at SME Branch, East Boring Canal Road, Patna, made recommendation for the loan of Rupees Three Crore to M/s. Vaishali Trading Company and, accordingly, the loan was sanctioned in favour of the
Patna High Court Cr.Misc. No.2315 of 2017 (2) dt.02-02-2017 2/2 Company but the Company was not installed nor the loan was returned to the Bank. Later on, in course of verification of the document, the Title deed, which was furnished by the Company, was not found genuine.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner was granted anticipatory bail by a Bench of this Court vide order dated 30.08.2016 passed in Criminal Misc. No.8919 of 2016 but he could not surrender within time as granted by this Court and, later on, the petitioner surrendered in the court below and he is in custody since 10.11.2016. Further submission is that, now, the chargesheet has been submitted against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge CBI-I, Patna, in connection with Special Case No.9 of 2012 pertaining to RC 0232012 A 0016.
