1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Bihiya P.S. Case No. 38/2023, registered for the offence punishable under Sections 341, 323, 354, 307, 325, 379 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and have been falsely implicated in the present case by the informant with general and omnibus allegation. It is next submitted that against the petitioner no.1, it is alleged that he snatched the golden

No.7404 of 2024(2) dt.01-03-2024 2/2 chain of Bindu Devi and the accused persons including the petitioner no.2 and 3 assaulted the informant and his side but then the allegation of assault is not specific. It is further submitted that no doubt one of the injuries suffered by Rajesh Kumar is said to be grievous but then the said injury is non-vital part of the body i.e. on the hand. It is also submitted at the cost of repetition that petitioners are persons with clean antecedent.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Bhojpur, Ara in connection with Bihiya P.S. Case No.38/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
