It is further evident from the office note that the appeal has been filed beyond the period of limitation and so, appellant was directed to file petition for condonation of delay.

This appeal has been filed in the year 1986 against the judgment dated 28.6.1986 passed by the 4th Addl. District and Sessions Judge, Saran at Chapra dismissing the petition under section 9 of the Hindu Marriage Act.

Considering pendency of the appeal since 1986 without prayer for condonation of delay on account of indifference attitude of the appellant, it looks appropriate to reject the Memo of Appeal and is accordingly, rejected.
