JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 This is an application for grant of anticipatory bail in connection with Baruraj P. S. Case No. 176 of 2019 disclosing offences under Sections 304(B), 201, 120(B)/34 of IPC. As per F.I.R., case is under Section 304B IPC with allegation of demand, assault and also killing her. Petitioners happens to be the father-in-law and unmarried Nanad. Submission of the learned counsel for the petitioners is that the allegation is general and omnibus in nature. No specific allegation has been attributed against them. Heard learned A.P.P. also who has opposed the prayer for bail on the ground that with respect to demand she was subjected to assault due to which she died.

No.1685 of 2020(2) dt.14-01-2020 2/2 Having heard both sides, considering the submissions, as made above, so far petitioner no.1 is concerned, I am not inclined to privilege to anticipatory bail to him. However, if he surrender and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by this order. So far, petitioner no. 2 is concerned, considering that she is an unmarried lady, let petitioner no. 2 above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of he lke amount to the satisfaction of learned JM 1st Class, Muzaffarpur, in connection with Baruraj P.S. Case No. 176 of 2019.
