JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
The deceased was first wife of FIR named accused, Dudha Paswan, whereas petitioner happens to be second wife of the aforesaid accused Dudha Paswan. Informant claims that coaccused Dudha Paswan as well as other including the petitioner committed the murder of deceased and disposed of her dead body due to family feud.
Learned trial court has referred paragraph Nos. 10, 56 and 77 of the case diary and on the basis of the aforesaid paragraphs, rejected the bail prayer of the petitioner. However, from perusal of entire case diary, I find that
Patna High Court CR. MISC. No.441 of 2019(3) dt.28-03-2019 2/2 except suspicion there appears to be nothing against the petitioner. The investigation of the case has already been completed. Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate X, Bhojpur /concerned Court in connection with Charpokhari P.S. Case No. 178/2018.
