JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2019 This is an application for grant of anticipatory bail in connection with Raushanganj (Bankey Bazar) P.S. Case No. 134 of 2018, disclosing offences under Sections 341, 376, 511 of the Indian Penal Code.
Allegation against the petitioner is of attempting to commit rape upon the informant and on hulla, one person namely Sujit Kumar came and try to catch the petitioner, but he fled away and Sujit Kumar disclosed the name of the petitioner. Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and he is next door neighbour of the informant, but in spite of that she has not named the petitioner, later on, the name of the petitioner disclosed by one Sujit Kumar. Further, he has no criminal antecedent and aged about 55 years.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, Gaya, in connection with Raushanganj (Bankey Bazar) P.S. Case No. 134 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
