JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 07.09.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, when the further statement of informant was recorded she stated that petitioner was close friend of first information report named accused, Rajnath Sahni and after that some witnesses claimed to have seen the petitioner coming out from the hut along with first information report named accused, Rajnath Sahni and except the aforesaid material, there appears to be nothing against the petitioner.

Patna High Court Cr.Misc. No.2122 of 2015 (2) dt.20-01-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 359 of 2014.
