JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06/ 04.09.2015 FSL report in sealed cover has been received and seal was broken in open court in presence of learned counsels for the parties. Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

It is alleged that 1 1⁄2 kg Charas like substance kept in three separate packets were recovered from possession of the petitioner. The sample of recovered substance was sent for chemical examination to Forensic science laboratory and the report says that seized substance was Charas.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant the privilege of bail to the petitioner and hence, her prayer for bail in connection with NDPS case no. 15/2014 arising out of Motihari P.S. case no. 28/2014 pending in the court of the Addl. Sessions Judge II, East Champaran at Motihari stands rejected.

Patna High Court Cr.Misc. No.1830 of 2015 (6) dt.04-09-2015 Office is directed to seal the FSL report again and send it to the concerned court immediately for needful.
