Petitioners apprehend their arrest in connection with Nanpur P.S. Case No. 513 of 2022 registered for the offences punishable under Sections 341, 323, 353, 504, 506/34 the Indian Penal Code and section 7 of the Essential Commodities Act and 33 NFS Act.

As per the prosecution case, the informant, Block Supply Officer, Nanpur, investigated the PDS shop of the petitioner but the FIR named accused persons including the petitioners not co-operated in the inquiry and disturbed the government work functionary.

Learned counsel for the petitioners submitted that

Patna High Court CR. MISC. No.3247 of 2023(2) dt.04-05-2023 2/2 petitioners have falsely been implicated in this case. Petitioner no. 1 has filed complaint case against Block Development Officer regarding misbehaviour with her which is annexed as Annexure 2 and 3. It is further submitted that no specific allegation is attributed against the petitioners and in retaliation the informant is violated the procedure of law. It is further submitted that petitioners have clean antecedents as stated in para-3 of this application.

Considering this fact that there is no specific overt act attributed against the petitioners as well as submission of the parties, let the above named petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 25,000/- ( Twenty Five thousand) each with two sureties of the like amount to the satisfaction of the learned Sub- Divisional Judicial Magistrate, Pupri, Sitamarhi in Nanpur P.S. Case No. 513 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) N.K/- U T
