JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-03-2016 Heard learned counsel for the petitioner as well as learned counsel, appearing for the Vigilance. Petitioner seeks bail in a case registered under Sections-7, 8, 13(2), 13(1) read with 13(1)(d) of Prevention of Corruption Act.
The petitioner is languishing in jail custody since 0810-2015 on the accusation that he took bribe of Rs. 1,000/- from the allegation maker.
Submission on behalf of the petitioner is that according to prosecution case itself, it was police inspector, who directed the allegation maker to meet the petitioner and the allegation maker claimed that he had given Rs. 5,000/- in bribe but only Rs. 1,000/- is said to have been recovered from conscious possession of
Patna High Court Cr.Misc. No.10641 of 2016 (3) dt.11-03-2016 2/2 petitioner. It is further submitted that as a matter of fact, the concerned inspector took the bribe but officials of Vigilance implicated the petitioner in the alleged crime to save the skin of concerned inspector. It is further submitted that moreover, charge has already been framed against the petitioner. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Special Case No. 50 of 2015 (Mohania P.S. Case No. 397 of 2015) to the satisfaction of learned Special Judge, Trap, Patna.
