JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being husband of the informant is in jail custody since 29.06.2014 in a case registered for the offences punishable under Sections 323, 506, 498 A of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.
Admittedly, the marriage of informant was solemnized with the petitioner in the year 1997 and she led happily and peaceful life for some period but after that the informant filed Chakia P.S. Case No. 124 of 2003 for the offences punishable under Sections 498A of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act against the petitioner which was ended in compromise.
Patna High Court Cr.Misc. No.1694 of 2015 (2) dt.15-01-2015 It appears that there is no possibility of restoration of matrimonial discord of the parties.
Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Mishra, Judicial Magistrate 1st Class, Sadar Motihari, East Champaran in connection with Chakia P.S. Case No. 143 of 2013.
