JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 149(0) of 2018 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

241.92 litres of liquor is said to have been recovered from the house of one Sanjay Sharma. The name of the petitioner has transpired in the confession of aforesaid Sanjay Sharma.

The petitioner does not have any criminal antecedents.

Regard being had to the aforestated facts viz. no recovery from the constructive possession of the petitioner

Patna High Court Cr.Misc. No.331 of 2019(2) dt.29-01-2019 2/2 and he being a person of clean antecedents, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge (Excise) Act, Buxar in connection with Excise Case No. 149(0) of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
