JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 14/11/2014 in Complaint case for the offences punishable under Sections 408, 465, 466, 471 and 381 of the Indian Penal Code. It is alleged that the complainant was appointed as Mahanth of Thakurbari of Sitaram Jee Maharaj known as Paharibaba Mandir .Subsequently the petitioner started working as a priest of the temple under the permission of the complainant but started claiming himself Mahanth and sold the tree and other things of the temple.

Learned counsel for the petitioner submits that there is dispute with regard to the appointment of Mahanth of the alleged temple. The petitioner filed Title Suit no.128/07 in which complainant became intervenor.

Patna High Court Cr.Misc. No.2613 of 2015 (2) dt.21-01-2015 2/2 Considering the accusation in the back ground of dispute, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Begusarai in connection with Complaint Case No. 9433C of 2013.
