2. The petitioners apprehend their arrest in connection with Suryapura P.S. Case No. 280 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 118(2), 117(2), 109, 351(2), 352 and 3(5) of the B.N.S.
3. The prosecution case in brief is that on the alleged date and time of occurrence, all the accused persons misbehaved with the informant which was objected by the son of the informant upon which petitioner nos. 2 and 3 assaulted with lathi and when petitioner no. 3 pushed her on the ground by
Patna High Court CR. MISC. No.2824 of 2025(2) dt.15-02-2025 2/3 holding her hair. Thereafter, all the accused persons assaulted the informant with lathi and Gahdal due to which she sustained injury. When informant's husband came to save her, all the accused persons assaulted him due to which his hands broken.
4. Learned counsel for the petitioners submit that petitioners are innocent and have falsely been implicated in this case. He further submits that on the alleged date of occurrence, scuffle took place between both the parties in which family members of the informant assaulted petitioner no. 3 for which a Complaint Case No. 611 of 2024 has been lodged by the mother of the petitioner nos. 2 and 3 against the informant and her family members in the court of learned Additional Chief Judicial Magistrate-1, Bikramganj, Rohtas. Injury sustained by informant and her son is simply in nature. Petitioners have clean antecedent.
5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioners.
6. Considering the aforesaid facts of the case and also considering the clean antecedent of the petitioners, the prayer for anticipatory bail of the petitioners are allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the petitioners above
Patna High Court CR. MISC. No.2824 of 2025(2) dt.15-02-2025 3/3 named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Bikramganj, Rohtas, in connection with Suryapura P.S. Case No. 280 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S.
