JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Six drums were recovered from the house of the petitioner and in one drum, 100 liters country made liquor were found and apart from that, one country made Katta was also recovered from the house of the petitioner.
No doubt, petitioner is in jail custody since 21.11.2015, but it would appear from perusal of Para-3 of the petition that almost similar type of cases had earlier been lodged against the petitioner.
. Considering the criminal antecedent as well as recovery, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Baikunthpur P.S.Case No.196 of
Patna High Court Cr.Misc. No.7888 of 2016 (2) dt.19-02-2016 2/2 2015, pending in the court of the 3rd Additional Chief Judicial Magistrate, Gopalganj stands rejected.
However, the trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/ production of copy of this order, failing which the petitioner may renew his prayer for bail before the learned court below.
