JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-02-2023 This criminal revision application has been filed against order dated 22.01.2020 passed by learned Principal Judge, Family Court, Buxar in Maintenance Case No. 57M of 2015 whereby and whereunder the learned Principal Judge has allowed the petition filed by opposite party, who is wife of petitioner, under Section 125 Cr.P.C. and directed the petitioner to pay Rs. 4,000/- per month towards maintenance of his wife (opposite party) and Rs. 2,000/- per month each towards maintenance of his son and daughter.
It is submitted by learned counsel for the petitioner that petitioner is a labourer and presently working in a factory in Delhi and earns Rs. 30,000/- per month and therefore, he is not
Patna High Court CR. REV. No.119 of 2021(2) dt.16-02-2023 2/2 in a position to pay such maintenance, as directed vide impugned order.
I have carefully perused the impugned order. The monthly maintenance allowance of Rs. 4,000/- per month to wife of petitioner and Rs. 2,000/- per month each to son and daughter of petitioner in this age of high inflation cannot be said to be excessive. I do not find any illegality or irregularity in the impugned order, which requires any interference by this Court. Accordingly, this criminal revision application stands dismissed.
