The petitioner has preferred this application for grant of regular bail in a case registered under sections 399, 402, 400, 414, 411 and 216A of the Indian Penal Code, sections 25(1B)(a), 26 and 35 of the Arms Act and sections 8, 20(b)(ii)B and 27A of the NDPS Act.

As per the prosecution case, three accused persons were arrested and from the vehicle in which they were present 1 kg ganja, a loaded katta besides other articles were recovered. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the person or vehicle of the petitioner. The petitioner has been falsely

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the period in custody, the Court directs the petitioner to be enlarged on bail in connection with Mohaniya P.S. Case no. 240 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Kaimur at Bhabua.
