The petitioner had earlier moved for bail in connection with S.T. No. 81 of 2015 arising out of Amdabad P. S. Case No. 209 of 2014 for the alleged offences punishable under Sections 302/34 of I.P.C. in Cr. Misc. No. 12601 of 2015 which was rejected on 28.08.2015. However, the petitioner brings to my notice the order dated 04.11.2015 passed in Cr. Misc. No. 36857/2015 by which the step brother of deceased Md. Mubaraque@ Md. Mobarak @ Mubarak has been granted the privilege of bail by a Co-ordinate Bench of this Court. The petitioner's name has surfaced on the confessional
Patna High Court Cr.Misc. No.5485 of 2016 (2) dt.03-02-2016 2/2 statement of co-accused Md. Mubaraque, who has confessed his guilt before the villagers that he along with the petitioner Santosh Ravidas has killed Jahanur Begum in the night. Since the step brother of the deceased Md.
Mubaraque has already been granted privilege of bail by this Court, I do not propose to take a different view, especially since the petitioner is in jail custody since 14.12.2014. Considering the facts and circumstances, the above named petitioner, Santosh @ Santosh Ravidas @ Nijak Ravidas is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge- III, Katihar in connection with S. T. No. 81 of 2015 arising out of Amdabad P. S. Case No. 209/2014.
