From perusal of the report dated 8.11.2019, it appears that the court below was kept in dark and was not apprised of the order passed by this Court on 4.2.2019. It also transpires from the letter dated 8.11.2019 that charge has not been framed in the instant case due to non availability of the original case diary which is lying in the court of District and Sessions Judge in Criminal Appeal No. 41/19.
