JUSTICE AMARESH KUMAR LAL ORAL ORDER 12-03-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 354, 324, 307/34 IPC and 27, 25(1-B)26/35 of Arms Act and 3(XI) SC/ST Act. Allegation against the petitioner and others is that while dance and singing were going on, they came there and within five minutes firing was made which caused injury to the wife of the informant and fire-shot crossed and hit the boy Bablu Soren aged about 8 years. Both of them became injured. Out of four three were apprehended by the co-villagers and the petitioner is one of them and firearm was recovered from the possession of Pramod Yadav.

It is submitted that there is no specific allegation

Patna High Court Cr.Misc. No.1699 of 2015 (3) dt.12-03-2015 2/2 against the petitioner nor any firearm has been recovered from his possession and Pramod Yadav from whose possession the firearm was recovered, has been granted bail by the learned Sessions Judge. The petitioner has no criminal antecedent. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Shri Shyam Lal Kumar, Judicial Magistrate, 1st Class, Jamui in Jhajha P. S. Case No. 164 of 2014 with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
