JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2016 The present application has been filed for modification of the order dated 02.12.2015 passed in Cr. Misc. No. 54690 of 2015 to the extent that it has wrongly been incorporated in para 5 of the order that the motorcycle belongs to the petitioner. In fact the alleged recovered motorcycle does not belong to the petitioner. A statement to that effect has been made in para 4 of the present modification application which reads as follows:- "That as a matter of fact alleged recovered motorcycle not belongs to the petitioner"

On the grounds mentioned in the modification application, let the said portion incorporated in para 5 of the order dated 02.12.2015 passed in Cr. Misc. No. 54690 of 2015 be deleted.

The order dated 02.12.2015 stands modified to the extent indicated above.

Accordingly the modification application

Patna High Court Cr.Misc. No.2234 of 2016 (2) dt.03-02-2016 2/2 stands disposed of in connection with Saraiya P.S. Case No. 474 of 2014, pending in the Court of learned Additional District Judge-IV, Muzaffarpur.
