The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. Submission is that the petitioner is neither named in the F.I.R. of the occurrence of robbery nor the petitioner has got any criminal antecedent. Petitioner is in custody since 27.11.2020. He was not put on T.I. parade during investigation of the case nor any incriminating article was recovered from his possession. The impugned order would reveal that since the brother of the petitioner was suspected to be involved in the occurrence, the petitioner has been named as accused in the case.

Considering the lack of material against the petitioner

Patna High Court CR. MISC. No.12741 of 2021(2) dt.19-03-2021 2/2 for the purpose of consideration of prayer for bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sohsarai P.S. Case No. 201 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
