The petitioner is in custody in connection with Excise Case No. 221 of 2018, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that in the instant case total 30 liters Nepali liquor was seized. Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner and petitioner is in custody since 11.5.2018.

Considering the fact that the petitioner has no criminal

No.1584 of 2019(2) dt.28-01-2019 2/2 antecedent and he has remained in custody for more than eight months, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari, East Champaran, in connection with Excise P.S. Case No. 221 of 2018.
