The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 347, 341, 323, 307, 387, 386 and 34 of the Indian Penal Code. The informant alleges that on 09.04.2020 at 7:00 PM, while he was returning from his brother's sasural, he was intercepted by three named accused persons, including the petitioner, and 3-4 unknown accused armed with pistol, it is next alleged that the accused made him sign on 29 papers relating to sale of motorcycle and even demanded extortion of Rs. 1 lakh and also threatened to kill in the event, if extortion amount is not paid.

Learned counsel for the petitioner submits that the

No.2975 of 2022(2) dt.16-08-2022 2/2 petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that though there is an allegation of extortion but admittedly nothing was paid. Learned counsel further submits that the date of occurrence is 09.04.2020 and the F.I.R. came to be instituted on 11.04.2020 i.e., after a delay of two days without any plausible explanation.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bakhtiyarpur P.S. Case No. 106 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
