Petitioner is said to have set the fire on the houses of the informant and his brother but submission on behalf of the petitioner is that the petitioner happens to be maternal uncle of the informant and due to land dispute, he has been roped in this case. It is further contended by him that according to the prosecution case itself, alleged occurrence took place on 17.12.2015 whereas FIR was lodged on 22.12.2015.

Taking note of the aforesaid submissions as well as this aspect of the matter that the informant only claimed to have seen the petitioner fleeing from the place of occurrence, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Rafiganj P.S.
