Petitioner seeks regular bail in connection with Bihpur PS Case No. 532 of 2022 dated 30-09-2022 registered under Section 08, 17(b), 22(b) of the N.D.P.S. Act. As per the FIR Police upon secret information conducted raid in the house of the petitioner and found 05 gram of smack like material from pocket of Rana Mandal, another 05 gram of smack like material was also found from the possession of the co-accused / Priyanka Kumari kept in a sachet of silver paper. 04 pieces of cigarettes, 09 pieces of empty cigarettes, 16 pieces of empty match box, 30 pieces of silver paper, 100 pieces of burnt match sticks, 50 pieces of filters of used cigarettes and approximately 10 gram of dust of burnt cigarettes

Patna High Court CR. MISC. No.7417 of 2023(2) dt.03-05-2023 2/3 were recovered from the bed of the petitioner. Learned counsel for the petitioner submits that petitioner has got no criminal antecedent of similar nature of offence and he has falsely been implicated in the present case. He next submits that the co-accused / Rana Mandal from whose possession smack like material has been recovered has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. 72200 of 2022. He further submits that petitioner is in custody since 05.12.2022 and charge sheet has already been submitted. Regard being had to the submission made by the parties, taking into consideration the material on record, the fact that petitioner is in custody since 05/12/2022 having no criminal antecedent, the co-accused / Rana Mandal has been granted bail by a Co-ordinate Bench of this Court, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Bhagalpur in connection with Bihpur PS Case No. 532 of 2022 on condition that the petitioner shall remain physically present on each and every date during the course of trial and in case of
