The petitioner is languishing in jail since 08.08.2014 in a case registered for the offences punishable under sections 25(1-B)a, 26(1)/35 of the Arms Act.
It is alleged that from a motorcycle three semi automatic pistol of 9 mm bore, and two magazines were recovered.
It is submitted by the learned counsel for the petitioner that the motorcycle was used by the brother-in-law of co-accused and the petitioner's name transpired during the investigation. It is further submitted that nothing has been recovered from his possession though the petitioner is accused in
Patna High Court Cr.Misc. No.998 of 2015 (2) dt.12-01-2015 five other case he is on bail in those cases and a statement to that effect has been made in paragraph 3 of the petition. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Munger, in connection with Jamalpur P.S. Case No. 137 of 2013. The learned court below will cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or substantially gets involved in some serious nature of offence.
