The petitioners seek bail in Saraiya P.S. Case No. 773 of 2021, registered for the offence punishable punishable under Sections 272, 273/34 of the Indian Penal Code, section 30(a) of the Bihar Prohibition and Excise Act, 2016 and section 20/22 of the Narcotic Drugs and Psychotropic Substances Act. 60 litres of country made liquor and 250 gms of Ganja has been recovered from possession of co-accused Deepak Kumar Gupta. These petitioners were seen fleeing away from the place of recovery.

It is submitted that no recovery has been made from

Patna High Court CR. MISC. No.3482 of 2022(2) dt.31-03-2022 2/2 conscious possession of these petitioners. Recovery has been made from possession of co-accused. Petitioners are in custody since 18.11.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is complete. Considering the period of custody coupled with the fact that petitioners bear clean antecedent, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Muzaffarpur in connection with Saraiya P.S. Case No. 773 of 2021.
