JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 10-07-2019 On repeated calls, no one appears for the petitioner. In the instant application preferred under Articles 226 and 227 of the Constitution of India, the petitioner has prayed for issuance of a direction to the respondents to institute an FIR and investigate the same in connection with Complaint Case No. 01 of 2015 in which the learned Judicial Magistrate, Railway, Kiul, Lakhisarai has directed for investigation in exercise of his power conferred under Section 156(3) of the Code of Criminal Procedure.

WJC No.296 of 2017(2) dt.10-07-2019 2/2 A counter affidavit has been filed on behalf of the State wherein it has been stated that pursuant to the direction issued by the learned Judicial Magistrate, Railway, Kiul, an FIR vide G.R.P. Jhajha P.S. Case No. 91 of 2017 has already been registered on 08.04.2017 inter alia under Sections 384 and 379 of the Indian Penal Code.
Learned counsel for the State submitted that the grievance raised by the petitioner has already been redressed. In view of the assertions made in the counter affidavit and the submission made by the learned counsel for the State, the application is disposed of.
